1. Who we are
ExamAce (“ExamAce,” “we,” “our,” or “us”) operates the ExamAce.ca exam prep platform for Ontario real estate licensing candidates. ExamAce is an independent service and is not affiliated with, endorsed by, or connected to the Real Estate Council of Ontario (RECO), Humber College, or any other regulatory body or education provider.
2. Acceptance of these terms
By creating an account, subscribing, or otherwise using ExamAce, you confirm that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the service.
3. Eligibility
You must be at least 18 years old and legally capable of entering into a binding contract under the laws of Ontario, Canada. By using ExamAce, you represent that you meet these requirements and that the information you provide is accurate and complete.
4. Accounts
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at [email protected] if you suspect unauthorized access. You may not share your account, sublicense your access, or use the service on behalf of another person.
5. Subscriptions and billing
ExamAce offers a free tier (three courses) and paid subscriptions. Paid plans are billed in Canadian dollars by our payment processor, Stripe. Current prices are listed on our pricing page and are subject to change with 30 days’ notice prior to your next renewal.
- Monthly subscription: Billed monthly in advance. Renews automatically on the same day each month until canceled.
- Annual subscription: Billed once per year in advance. Renews automatically on the anniversary date until canceled.
- Auto-renewal: All paid plans renew automatically until you cancel. You can cancel at any time from your account settings or the Stripe billing portal.
- Cancellation: Cancellation takes effect at the end of the current billing period. You retain access until then.
6. 30-day money-back guarantee
If you subscribe to a paid plan and are not satisfied, contact us at [email protected] within 30 days of your initial subscription for a full refund of the most recent payment. The guarantee applies only to the first paid period (your initial monthly or annual charge). Subsequent renewals are not refundable, but you may cancel any time to prevent future charges.
7. Acceptable use
You agree not to:
- Copy, redistribute, resell, or republish ExamAce content (including questions, explanations, and study guides) without written permission.
- Scrape, mirror, or systematically harvest content using automated tools.
- Share your account credentials with anyone else.
- Reverse engineer, decompile, or attempt to extract source code from the service.
- Use the service to violate any applicable law, including the Trust in Real Estate Services Act, 2002 (TRESA), the Ontario Human Rights Code, or RECO regulations.
- Submit false or misleading information, impersonate another person, or interfere with other users’ access to the service.
We may suspend or terminate accounts that violate these rules without refund.
8. Intellectual property
All content on ExamAce — including practice questions, explanations, study guides, course structures, branding, and software — is owned by ExamAce or its licensors and protected by Canadian and international copyright and trademark law. We grant you a limited, non-exclusive, non-transferable license to access and use the content for your personal exam preparation.
References to third-party programs (Humber College, RECO, OREA, CREA, etc.) are made for identification purposes only under nominative fair use. We do not claim affiliation, endorsement, or any rights in their trademarks.
9. AI tutor and generated content
ExamAce includes an AI tutor that generates explanations and study assistance. AI-generated responses are provided for educational purposes only and may contain errors, omissions, or outdated information. AI output is not legal, financial, regulatory, or professional advice. Always verify regulatory and statutory information against primary sources (RECO bulletins, Ontario e-Laws) and consult a licensed real estate professional, lawyer, or RECO directly for binding guidance.
10. No guarantee of exam outcomes
ExamAce is a study tool. We do not guarantee that you will pass any real estate exam, complete any program, obtain any license, or achieve any specific outcome. Exam results depend on many factors outside our control, including your study habits, prior knowledge, and the specific exam administered. Statements such as “built from the official RECO competency framework” describe our content sourcing approach, not an outcome promise.
11. Disclaimers
The service is provided “as is” and “as available” without warranty of any kind, express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, secure, or free of harmful components.
12. Limitation of liability
To the maximum extent permitted by law, ExamAce, its directors, officers, employees, and contractors are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from your use of the service. Our total cumulative liability for any claim arising under these terms will not exceed the amounts you paid to us in the twelve months preceding the claim.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so portions of this section may not apply to you.
13. Indemnification
You agree to indemnify and hold harmless ExamAce and its representatives from any claim, demand, loss, or expense (including reasonable legal fees) arising out of your breach of these terms, your misuse of the service, or your violation of any law or third-party right.
14. Termination
You may stop using the service and cancel your subscription at any time. We may suspend or terminate your access if you breach these terms, if required by law, or if we cease offering the service. On termination, your right to use the service ends immediately. Sections that by their nature should survive (Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Governing Law) will survive.
15. Modifications to the service and terms
We may update the service and these terms from time to time. Material changes to these terms will be communicated by email or by prominent notice on the site at least 30 days before they take effect. Your continued use after the effective date constitutes acceptance of the revised terms.
16. Governing law and dispute resolution
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. The courts located in Toronto, Ontario have exclusive jurisdiction over any dispute arising out of or relating to these terms or the service, except that either party may seek injunctive relief in any court of competent jurisdiction.
